Terms of Service
The International Caregivers Association (ICA) website is NOT a medical website. It was developed to provide dementia-care training, education, coaching, and consulting useful to individuals and businesses who have a desire to adopt a universal standard of delivering such care services to individuals living with Alzheimer and dementias. We do not have medical personnel on staff or on retainer to answer medical questions. We do not make any medical referrals or offer second opinions about existing medical conditions such as Alzheimer, and we cannot offer medical information about any specific case because every case is different. Instead, we hope that you will use the training offered with your membership, visit all our links, and find the knowledge helpful. Please use our contact page to share ideas and ask questions. The ICA reserves the right to deny membership to individuals who do not meet the basic membership criteria. Our trainers educators coaches and consultants have entered into contract with the ICA. They are professionals such as published authors, researchers, doctors, nurses, professors, or teachers. Some are non-professionals but experienced in the knowledge they bring to the ICA. All share and offer knowledge that you might find helpful in minimizing the day-to-day responsibilities of caring for someone living with dementia and/or maximizing the quality of life. ICA contributors and sponsors on this website believe to the best of their knowledge that the information presented is accurate, complete, and helpful. Our motto is
“priming for compliance to minimize or reduce resistance” on the part of the care receiver. Our goal is to provide training that allows healthcare workers, professionals, and families reduce resistance by adopting universal proven techniques, information, and knowledge gained on this website.
Exclusions and Limitations
The information on the ICA website is provided on an “as is” basis. To the fullest extent permitted by law the ICA:
- Excludes all representations and warranties relating to this website its contents or which is or may be provided by any affiliates or any other third party, including in relation to any inaccuracies or omissions in this website and/or the ICA’s literature; and
- Excludes all limitation, direct loss, loss of business or profits (whethernot the loss of such profits was foreseeable, arose in the normal course of things or you have advised the ICA of the possibility of such potential loss), damage caused to your computer, computer software, systems and programs and the data thereon or any other direct or indirect, consequential and incidental damages.
The above exclusions and limitations apply only to the extent permitted by law. None of your statutory rights as a consumer are affected.
PayPal Payments and Certified Bank Cheques are acceptable methods of payment. Our terms are payment in full upon receipt. Outstanding or unpaid invoices will deny you access to training and services. Returned cheques will incur a $20 charge to cover banking fees and administrative costs.
Minimum 24 hours notice of cancellation is required when someone pays for membership (when applicable) or to register for a training (live or past training session, and for any other services/product. Notification for instance, via email, or any other means will be accepted subject to confirmation in writing. ICA reserves the right to levy a $20 charge to cover any subsequent administrative expense.
Termination of Agreements and Refunds Policy
Both the member/participant and ICA have the right to terminate any Services Agreement for any reason, including the ending of services that are already underway. No refunds shall be offered, where a Service is deemed to have begun and is, for all intents and purposes, underway. Any monies that have been paid to us which constitute payment in respect to the provision of unused Services, shall be returned.
If you use this site, you are responsible for maintaining the confidentiality of your account and password, and for restricting access to your computer; and you agree to accept responsibility for all activities that occur under your account or password. If you are under 18, you may use our website only with involvement of a parent or guardian. The ICA and its associates reserve the right to refuse service, terminate accounts, remove or edit content, or cancel orders in their sole discretion.
Right to Refuse Membership
It is a violation of your civil rights for the ICA to refuse a membership based on the way an individual looks, smells or acts. The Federal Civil Rights Act guarantees all people the right to “full and equal enjoyment of the goods, services, facilities, privileges, advantages, and accommodations of any place of public accommodation, without discrimination or segregation on the ground of race, color, religion or national origin.”
The right of public accommodation is also guaranteed to disabled citizens under the American’s with Disabilities Act (ADA), which precludes discrimination by the ICA on the basis of disability. The ICA may consider special request for discounted fees based on extreme poverty and other conditions in order to allow persons living in third-world countries and under extreme poverty. This clause may also be under constant state of change and therefore everyone is encouraged to watch for any changes which would be published on the homepage of this website.
Any decisions by the ICA to refuse membership to any person, or group of persons, is to protect the legitimate business interest in preventing other members from resigning based on someone’s action or for any other reason.
Membership Annual Fees
Membership is FREE.
Separate from the membership fee are the training fees for each live training session, coaching, and consulting. Non ICA members may register and pay a higher fee for a live training of their choice.
ICA has a license to use Go To Webinar and therefore it is the responsibility of each member/participating to familiarize him/herself with this platform. Simply visit and select the appropriate training segments at http://support.citrixonline.com/webinar/videos to familiarize yourself with this platform. It was especially selected because it is user friendly.
Any dispute relating in any way to your visit to the ICA website or to products you purchased through the ICA shall be submitted to confidential arbitration in the Office of the Attorney General, Consumer Protection Division, State of Maine, United States of America, except that, to the extent you have in any manner violated or threatened to violate the ICA’s intellectual property rights, the ICA may seek injunctive or other appropriate relief in any court, and you consent to exclusive jurisdiction and venue in such courts where permissible. Arbitration under this Agreement shall be conducted under the rules then prevailing of the American Arbitration Association. The arbitrator’s award shall be binding and may be entered as a judgment in any court of competent jurisdiction. To the fullest extent permitted by applicable law, no arbitration under this Agreement shall be joined to an arbitration involving any other party subject to this Agreement, whether through class arbitration proceedings or otherwise.
Reviews, Comments, Emails, and Other Content
Visitors may post reviews, comments, and other content in discussion threads for the ICA on LinkedIn: and submit suggestions, ideas, comments, questions, or other information, so long as the content is not illegal, obscene, threatening, defamatory, invasive of privacy, infringing of intellectual property rights, or otherwise injurious to third parties or objectionable and does not consist of or contain software viruses, political campaigning, religious preferences, sexual preference, commercial solicitation, chain letters, mass mailings, or any form of “spam”. You may not use a false e-mail address, impersonate any person or entity, or otherwise mislead as to the origin of a card or other content. The ICA reserves the right (but not the obligation) to remove or edit such content, but does not regularly review posted content. If you do post content or submit material, and unless we indicate otherwise, you grant the ICA and its associates a nonexclusive, royalty-free, perpetual, irrevocable, and fully sublicense right to use the name that you submit in connection with such content, if they choose. You represent and warrant that you own or otherwise control all the rights to the content that you post: that the content is accurate: that use of the content you supply does not violate this policy and will not cause injury to any person or entity: and that you will indemnify the ICA or its associates for all claims resulting from content you supply. The ICA has the right, but not the obligation, to monitor and edit or remove any activity or content. The ICA takes no responsibility and assumes no liability for any content posted by you or any third party.
Unless otherwise stated, the services featured on this website are available anywhere in the world where Internet connection is established. Live training and services may vary based on time zones and therefore the ICA promotes or advertises training and services in Eastern Daylight Time (EDT). It is the responsibility of the member/participant to convert time for live training. Reproduction or republication of any part of this site or its content/training webinars is prohibited, including such by framing or other similar or any other means, without the express written consent of the ICA. The ICA does not warrant that the service from this site will be uninterrupted, timely or error free, although it is provided to the best ability. By using this service you thereby indemnify the ICA, its employees, agents and affiliates against any loss or damage, in whatever manner, howsoever caused.
Copyright and other relevant intellectual property rights on all text relating to the ICA’s services and the full content of this website. The ICA logo is the sole property of the ICA in the United States and around the world.
We encourage members/participants to email the ICA using the CONTACT US tab or via ICA literature. You may expect a response within 48 business hours and sometimes within minutes. The ICA is registered with the State of Maine, the Department of the Secretary of State, Bureau of Corporations as a nonprofit organization, Charter #20160134ND and Certificate of Formation, DCN #2152741600031.
Neither party shall be liable to the other for any failure to perform any obligation under any Agreement which is due to an event beyond the control of such party including but not limited to an Act of God, terrorism, war, Political insurgence, insurrection, riot, civil unrest, act of civil or military authority, uprising, earthquake, flood or any other natural or manmade eventuality outside of our control. Any Party affected by such event shall forthwith inform the other Party of the same and shall use all reasonable endeavours to comply with the terms and conditions of any Agreement contained herein.
Failure of either Party to insist upon strict performance of any provision of this or any Agreement or the failure of either Party to exercise any right or remedy to which it, he or they are entitled hereunder shall not constitute a waiver thereof and shall not cause a diminution of the obligations under this or any Agreement. No waiver of any of the provisions of this or any Agreement shall be effective unless it is expressly state to be such and signed by both Parties.
The laws of the State of Maine in the United States of America govern these terms and conditions. By accessing this website [and using our services/buying our products] you consent to these terms and conditions and to the exclusive jurisdiction of the American courts in all disputes arising out of such access. If any of these terms are deemed invalid or unenforceable for any reason (including, but not limited to the exclusions and limitations set out above), then the invalid or unenforceable provision will be severed from these terms and the remaining terms will continue to apply. Failure of the ICA to enforce any of the provision set out in these Terms of Service or any Agreement or any part thereof, or the right thereafter to enforce each and every provision. These Terms of Service shall not be amended, modified, varied or supplemented except in writing and signed by duly authorized representatives of the ICA.
Notification of Changes
Please review our other policies posted on this site. These policies also govern your visit to the ICA. As stated previously, we reserve the right to make changes to our site, policies, and these Terms of Service at any time. If any of these conditions shall be deemed invalid, void, or for any reason unenforceable, that condition shall be deemed severable and shall not affect the validity and enforceability of any remaining conditions.
